Mahfud MD: “Gayus has impoverished people”

Jakarta, MKOnline - Chief Justice of the Constitutional Court (The Court) Moh Mahfud MD affirmed that the acts of corruption and bribery committed by Gayus Tambunan have spoiled law enforcement. Furthermore, Gayus’ mischief may lead thousands of Indonesian people into poverty.

"The people are being impoverished by Gayus. That kind of person should not only receive severe penalty, but must also be impoverished," Mahfud said to the reporters in his office, Tuesday (16/11) commenting on the tax mafia defendant, Gayus Tambunan who is still a popular person that people talk about. 

Mahfud believes that impoverishing the perpetrator of corruption like in China, Korea and Japan, constitutes a form of learning for the society as well as a form of prevention from the reoccurrence of the acts that Gayus committed.

“Remember that Gayus bribed a little but received a lot of bribes. That should be taken to the criminal process. In the criminal process, he received bribes, this means that not only he is subject to imprisonment, the proceeds of the bribes may also be confiscated by the state since they are proceeds of crime,” Mahfud explained. 

Mahfud said that it is not difficult to impoverish Gayus since he already made confessions as initial evidence to be penalized for receiving bribe. But for bribing, it would be difficult to impoverish him.

According to Mahfud, what Gayus did until he was able to walk out of the detention house and went to Bali was an extraordinary collusion. Because leaving the detention house can only be done with the permission from the chairperson of the panel of judges hearing the case. “Even the head of the detention house has no authority to give permission prior to the permission from the chairperson of the panel of judges. Now there lies a great problem,” Mahfud concluded. 

Mahfud explained that for the long run, the Indonesian government had actually made Law No. 7/2006 concerning Ratification of the International Convention on the Eradication of Corruption. “Therefore the Indonesian Government should make a Law concerning the procedures on how to make people deterred, to make people afraid of committing act of corruption, including how to impoverish the perpetrators of corruption. But until now such law is yet to exist. I believe that such Law should be made immediately, it is already been late for more than three years,” Mahfud said. (Nano Tresna A./mh)
